- SportChallenge.online: The service provider, based in the Netherlands
- User: The natural or legal person who uses the services of SportChallenge.online
- Services: All services offered by SportChallenge.online, including the web application and website
- Platform: The web application and website of SportChallenge.online

These terms and conditions apply to all agreements between SportChallenge.online and the user, as well as to all services offered by SportChallenge.online.
2. Services
2.1 Description of services
SportChallenge.online provides a platform for organizing and managing sports challenges, including:
- Creating and managing sports challenges
- Registering and tracking sports activities
- Calculating scores and standings
- Sending updates and notifications
- Sending paper versions of the SportChallenge
2.2 Availability
SportChallenge.online strives to keep the services available 24/7, but cannot guarantee that the services will be available without interruption. Maintenance, updates, and technical failures may lead to temporary unavailability.
3. User account
3.1 Creating an account
- Users must create an account to use the services
- Users are required to provide truthful and current information
- Users are responsible for the confidentiality of their account information
3.2 Account management
- Users are responsible for all activities that occur under their account
- SportChallenge.online is not liable for damage resulting from unauthorized use of an account
- Users must immediately report unauthorized use of their account
4. Use of services
4.1 Permitted use
Users may only use the services for:
- Organizing sports challenges
- Registering their own sports activities
- Managing participants in sports challenges
- Legitimate business purposes
4.2 Prohibited use
It is prohibited to use the services for:
- Illegal activities
- Sending spam or unsolicited messages
- Disrupting the operation of the platform
- Copying or reverse engineering the software
- Misusing the services in a manner harmful to other users
5. Payments and billing
5.1 Rates
- The rates for the services are listed on the website
- SportChallenge.online reserves the right to change rates
- Rate changes will be announced 30 days in advance
5.2 Payment
- Payments must be made in advance
- Non-payment may lead to suspension or termination of services
- All prices are exclusive of VAT, unless otherwise stated
5.3 Refund
- Refunds will only be granted in consultation and under special circumstances
- Refunds will be calculated pro rata for the unused period
6. Intellectual property
6.1 Ownership of services
- All intellectual property rights to the services rest with SportChallenge.online
- Users do not acquire ownership rights to the services
6.2 User content
- Users retain ownership rights to content uploaded by them
- Users grant SportChallenge.online a license to use this content for providing the services
7. Privacy and data protection
7.1 Privacy statement
The processing of personal data is regulated in our privacy statement.
7.2 Data security
SportChallenge.online takes appropriate technical and organizational measures to protect personal data.
8. Liability
8.1 Limitation of liability
- SportChallenge.online is not liable for indirect damage, consequential damage, or lost profit
- Total liability is limited to the amount the user has paid in the relevant year
8.2 Exclusion of liability
SportChallenge.online excludes liability for:
- Damage resulting from incorrect use of the services
- Damage resulting from technical failures or maintenance
- Damage resulting from actions of third parties
9. Termination
9.1 Termination by the user
- Users can terminate their account at any time
- Termination must be done in writing
9.2 Termination by SportChallenge.online
SportChallenge.online may terminate the account in case of:
- Violation of these terms and conditions
- Non-payment of amounts due
- Misuse of the services
9.3 Consequences of termination
- Upon termination, access to the services will be revoked
- Data will be retained in accordance with the privacy statement
- No refund of amounts already paid
10. Changes
10.1 Changes to services
SportChallenge.online reserves the right to modify or extend the services.
10.2 Changes to terms
- These terms and conditions may be amended
- Changes will be announced 30 days in advance
- By continuing to use the services, the user agrees to the amended terms
11. Other provisions
11.1 Applicable law
Dutch law applies to these terms and conditions.
11.2 Disputes
Disputes will be submitted to the competent court in the Netherlands.
11.3 Invalidity
If a provision of these terms and conditions proves to be invalid or voidable, the remaining provisions will remain in force.
11.4 Complete agreement
These terms and conditions together with the privacy statement constitute the complete agreement between the parties.
